Michael Jordan Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over alleged violations of antitrust rules.
Team Investment and a Competitive Drive
Jordan shared operational insights of his racing venture, revealing he put in $40 million of his own funds into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. I felt as far as the sport required examination from a different view.”
The Core Dispute: Franchise System and Contract Pressure
The heart of the case involves the end of a 2016 deal where Nascar provided each team a “charter”. This system mirrors other professional sports with separately owned franchises, such as the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with fans and media clamoring for a glimpse or a picture of the sports legend.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan said is breaking the law to keep two hands on the wheel.
At issue for Jordan and Heather Gibbs, who testified before Jordan, are events from last September. She recounted a hectic and tense period where the sanctioning body told teams they had to sign a charter agreement extension. This agreement consists of 112 pages detailing team compensation and a guaranteed spot in Nascar-sponsored races.
Choosing Litigation
Jordan explained that his team and its ally concluded their sole viable path was to refuse a signature that 112-page package and litigate the matter. The other 13 organizations signed the agreement.
Jordan and co-owner Denny Hamlin approached Nascar about possible changes or negotiations. Nascar refused to engage, according to his testimony.

“Denny convinced me adding a third car boosted our odds of winning,” he testified, noting that he bought a third charter last year for $28 million despite the uncertainty. “So I dove in.”

Gibbs described her push for indefinite franchises, submitted in a written letter to Nascar. She said the timing of the signature deadline didn’t sit well.
According to her, the team founder first attempted to call and persuade Nascar against demanding signatures, but CEO Jim France declined the request.
“Don’t do this to us,” Gibbs recounted was the message to Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, I have 20. If I have 30, I have 30.”
